This story is from a year ago but I think it doesn't make it any less interesting and educating. It's a story of a dog, hope you enjoy. I know it's long but please read it all.
It's summer 2011 a 27 year old man is having a fight with his wife. Before it he got drunk. In the other room their baby is crying. The man is looking for a dummy to keep it quiet but he can't fine it. He shouts at his wife again Their dog, a little mix breed reacts to the fight with barking. The man throws him out of the window on the second storey. The dog lands on his neighbours garden. The neighbours call the police. The man spends the night at the police station, he has 2 per mills of alcohol in his organism.
The dog lives but runs away. The wife of the man finds him the next day. He is bruised and has a few cracks in his skull. The woman tells the police she takes care of the dog and the animal goes back home.
Court: It's just an accident
Prosecutors accused the man of savere animal cruelty. He was threatened with three years of prison. The man agreed that it was his fault but said he did it because he was very angry and that he takes good care of the dog.
It wasn't high enough and the ground too soft.
The court sees it differently. They say the man wasn't cruel to the dog because he didn't make the dogs pain long. It would be like it if he for example chocked or stabbed the dog or threw him out of a window higher than the second storey.
"throwing a dog out of window on the 10th storey could be called cruelty, but throwing him out of a window on the second storey onto garden theritory is not,"- says the judge. Also another thing is them man was very angry and he threw the dog out quickly not causing it long mental injuries.
"Short time of pain and no mental injuries on one hand and the impulsive act of the man on the other hand, without savere pain towards the dog makes him innocent. All he did that under stress and anger he threw thedog out of the window.," says the judge and insists the dog didn't suffer from too bad of an injury.
The judge makes the man innocent and only more incidents like that might change his mind. "It's not ethical and funny"- say the prosecutors.
Death s not a usual outcome of a fall from a second stoorey
The man won't also be prosecuted for trying to kill the dog, because?According to the court throwing a dog out of a window on the second storey should not be taken as an act understood as the word "kill" because "death of an animal is not a usual outcome of an event like that. The court says that if the man wanted to kill the dog he would throw him of from a higher floor.

For me even thinking of throwing your dog out of the window no matter in what state of mind should be considered as animal cruelty. They dog even though was not very badly hurt still felt pain and had to go threw a thraumatic experience of falling. Look at it this way, if a human was thrown out of a window on the second storey the person who did it would be prosecuted for sure no matter if he was drunk or not. Why isn't a dog treated like a human? Because it's just an animal. For me it's just terrible that the owner wasn't prosecuted in any way, he didn't even have to pay a fine. The jude must have a hearth of ice if he didn't feel any compashion for the dog. I think three years of jail is the least the man should get for causing a living thing pain, doesn't matter if it's a human or an animal.
